By creating an account or using the services at launchwithagency.com (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
The Service is operated by LaunchWithAgency ("we", "us", "our"). These Terms form a binding agreement between you ("User") and us.
LaunchWithAgency provides a suite of marketing tools — newsletters, blogs, landing pages, automation flows and transactional email — under a single account and database. Plan details, usage limits and pricing are at /pricing.
You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.
You represent that you are at least 18 years old or otherwise legally able to enter into contracts in your country of residence.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these rules, with or without prior notice.
You retain all rights to the content you submit to the Service (text, images, contact lists, customer data). By submitting content, you grant us a limited, non-exclusive license to store, process and display that content solely to operate the Service for you.
You are solely responsible for the legality of the content you submit, including the consent of the recipients of your emails.
Paid plans are billed monthly or yearly as selected at subscription. Payments are non-refundable except where required by law. You may cancel at any time; cancellation takes effect at the end of the current billing cycle.
We may change prices with 30 days' prior notice by email.
We aim to keep the Service available 24/7 but do not guarantee uninterrupted availability. Scheduled maintenance will be announced in advance when possible. We are not liable for unavailability caused by third parties (email providers, DNS, cloud infrastructure).
To the maximum extent permitted by law, LaunchWithAgency is not liable for indirect, incidental, consequential damages or lost profits arising out of or in connection with use or inability to use the Service.
Our total aggregate liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.
We may update these Terms from time to time. Material changes will be communicated by email at least 30 days in advance. Continued use of the Service after the changes take effect constitutes acceptance.
You may terminate your account at any time from the dashboard. We may terminate accounts that violate these Terms or have been inactive for more than 12 months.
After termination, your data is retained for 30 days to allow recovery and then permanently deleted.
These Terms are governed by the laws of Brazil. Disputes shall be settled in the courts of São Paulo, SP, except where mandatory consumer protection law provides otherwise.
